Stafford Man Nearly Rear-Ends Deputy, Pretends To March During Sobriety Test: Police

A 26-year-old man was chuffed about his performance on a field sobriety test and was confident he'd pass a breath test. He spent that night in jail on a DUI charge, authorities said.

Oscar Benavidez Jr. of Stafford was pulled over on Interstate 95 after he almost crashed into the back of a marked Stafford County sheriff's cruiser just after 10:30 p.m. on Wednesday, June 8, an incident report says.

When the deputy asked him to walk in a straight line as part of a field sobriety test, Benavidez acted as if he was in a military formation, the report continues. The deputy marked it as a failure, but Benavidez wrongly thought he'd passed. 

He was so confident in his performance that he told the deputy he expected to blow all zeros on an Intoxilyzer, the report said, but Benavidez blew between a .15 to .20 on the test. The legal limit is .08. 

The deputy took Benavidez to Rappahannock Regional Jail until he sobered up. Officials charged him with DUI, the report said.
